1. Acceptance of terms
These Terms of Service (“Terms”) are an agreement between you and spiri2, operator of Apex and Apex Lite (“Apex,” “we,” “us,” or “our”). By creating an account, accessing an Apex app, or continuing to use Apex, you agree to these Terms and the Apex Privacy Policy. If you do not agree, do not use Apex.
2. Use of the app
You agree to use Apex only for lawful purposes and in accordance with these Terms. You may not:
- Interfere with, damage, disable, reverse engineer, or disrupt the app or its infrastructure
- Attempt to bypass authentication, access controls, or feature restrictions
- Share credentials or allow access that compromises account security
- Violate applicable law or the rules of a third-party platform, service, or game
- Exploit bugs, abuse network resources, or distribute harmful, fraudulent, or misleading content
You are responsible for activity that occurs through your account.
3. Community features and user content
Apex may let you submit or share profile details, friend codes, raid or nest information, trade posts, votes, and other community content. You are responsible for information you submit and must have the right to share it. Do not post unlawful, misleading, abusive, infringing, or privacy-invasive content. We may remove content or restrict access to protect users, enforce these Terms, or comply with law.
4. Subscriptions and payments
Certain features may require a paid subscription or purchase. Where paid access is offered, payment may be handled by Apple or a third-party provider such as Stripe. Pricing, renewal timing, feature availability, and cancellation rules will be presented when you purchase. Apex does not directly store full payment-card details.
5. Intellectual property
Unless otherwise stated, Apex—including its design, branding, code, interface, text, and original features—is owned by spiri2 or used with permission. These Terms grant you a limited right to use the app; they do not transfer ownership of Apex or its content to you.
6. Third-party products and trademarks
Apex is an independent companion app and is not sponsored, endorsed, or affiliated with Niantic, The Pokémon Company, Nintendo, Apple, or other referenced game or platform owners. Names and trademarks belong to their respective owners. You are responsible for following applicable third-party terms when using Apex.
7. Disclaimer and limitation of liability
To the fullest extent permitted by law, Apex is provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted availability, absolute accuracy of community-submitted information, or an error-free service.
To the maximum extent permitted by law, Apex and spiri2 will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, access, profits, opportunities, or goodwill arising from your use of the app. These limitations do not apply where prohibited by law.
8. Privacy
Your use of Apex is also subject to the Apex Privacy Policy, which explains how information is collected, used, retained, and handled.
9. Suspension and termination
We may suspend or terminate access if these Terms are violated, misuse or abuse is detected, continued access creates risk for Apex or its users, or Apex is discontinued. You may stop using Apex at any time. Account deletion may be available through the app or by contacting us.
10. Governing law
These Terms are governed by applicable law, without regard to conflict-of-law principles, except where local consumer-protection law requires otherwise. Before filing a claim, please contact us and allow a reasonable opportunity to resolve the issue informally.
11. Changes to these terms
We may revise these Terms from time to time. Updated Terms will be posted on this page or otherwise made available through the app. Continued use after changes take effect means the revised Terms apply, to the extent permitted by law.
